內容提要:
主要從憲法學國家結構形式理論出發,著眼於我國的單一制國家結構形式,討論“一國兩制”背景下和《香港基本法》中所涉及的中央與特別行政區的關係。 具體內容包括中央與特別行政區的關係是單一制下的中央與地方的關係、基本法規定的中央與地方關係、香港特別行政區享有的高度自治權、中央與特別行政區關係的實踐等方面。
Abstract:
This talk, primarily rooted in the constitutional theory of state structural form, will focus on China’s unitary state structure and explore the relationship between the central government and the Special Administrative Region (SAR) within the framework of “One Country, Two Systems” and the Hong Kong Basic Law. Specifically, Professor Wang will examine the central government’s relationship with the SAR under a unitary system, its relationship with local governments as outlined in the Basic Law, the considerable autonomy granted to the Hong Kong SAR, and the evolution of this relationship in practice.

王磊,北京大學法學院教授、博士生導師,中國法學會憲法學研究會副會長,北京市人大常委會法治顧問,北京市政府立法諮詢專家。 獲北京大學法學院本科、碩士、博士學位。 研究方向為憲法行政法、港澳基本法。 研究成果有《憲法的司法化》《選擇憲法》《布什訴戈爾》等專著。 曾作為訪問學者訪問美國、瑞典等國家。 2010年7月,王磊教授應邀在韓國國會發表演講。 2018年「一地兩檢」案([2018]HKCFI2657)中出具的專家意見被香港高等法院採納,維護了特區政府的利益。
Speaker:
Lei Wang is a Professor of Law at Peking University. He also serves as the Vice President of the Constitutional Studies Research Society of the China Law Society, a Legal Adviser to the Beijing Municipal People’s Congress Standing Committee, and a Legislative Consulting Expert to the Beijing Municipal Government. He holds a bachelor’s, master’s, and doctoral degree from Peking University Law School. Professor Wang’s research interests include constitutional administrative law and the Basic Law of Hong Kong and Macao. He has authored numerous monographs such as “The Judicialization of the Constitution,” “Choosing the Constitution,” and “Bush v. Gore.” As a visiting scholar, he has traveled to the United States, Sweden, and other countries. In 2010, Professor Wang was invited to speak at the Korean Congress. One of his expert opinions was adopted by the Hong Kong High Court ([2018] HKCFI2657), protecting the interests of the SAR government.
