Digital Vulnerability: Lessons from Insurance Technologies

Abstract:
Insurance companies have always been at the forefront of developments in the processing of large volumes of data, and nowadays are increasingly experimenting with automated quantification, digitalisation, IoT and predictive AI technologies. But what are the implications of these developments for policyholders? Are emerging insurance technologies enhancing the protection of the insured or making them more vulnerable?

This talk seeks to answer these questions by analysing how insurance technologies are reshaping the insurance industry and its customers. It will explore whether the legal framework, particularly insurance regulation and emerging AI regulation, offers adequate safeguards in this evolving landscape. The session will also include interactive discussions on the extraterritorial impact of the EU legislation on non-EU based insurance companies and their customers.

Speakers:
Marta Infantino is Associate Professor of Private Comparative Law at the University of Trieste (Italy). She has been a Visiting Professor at prominent global institutions such as the Universidad de los Andes (Colombia) and the Université de Montréal (Canada). She is Associate Member of the International Academy of Comparative Law and Chair of the ‘Tort Law’ stream within the ‘Common Core of European Private Law’ project. She has published extensively in Italian, English and French on comparative tort law, comparative contract law, global legal indicators and emerging technologies for social quantification.

Pierpaolo Marano is a Professor of Insurance Law at the University of Malta and the Catholic University of Milan. He is an academic member of Insurance and Reinsurance Stakeholder Group at European Insurance and Occupational Pensions Authority (EIOPA) and Co-Chair of International Insurance Law Association Europe (AIDA Europe). He leads the AIDA World Working Party on the Distribution of Insurance Products and has served as a visiting professor at several universities, including the University of Connecticut, China University of Political Science and Law (CUPL), the University of International Business and Economics (UIBE), and National Taiwan University. He has authored over 140 academic publications and directs the AIDA Europe Research Series on Insurance Law and Regulation, published by Springer.
